My County is a Horror Show and what he believes about Americans enjoying the same rights. David Simon believed that happiness involves money, land and opportunity. Lastly I will give my opinion on what I believe the right to pursue happiness involves and means. According to the first draft of The Declaration of Independence, people’s rights were being ignored by the King. Thomas Jefferson once said â€Å"mankind is more disposed to suffer, while evils are sufferable, than to right themselves by abolishing the forms to which they are accustomed† (Jefferson,1), this is telling us that the people are allowing the corrupt government to take over their life and put them through suffering that they do not deserve or want. â€Å"Governments are instituted among Men, deriving their just powers from the consent of the governed† (Jefferson, 1), this one ruler mentality also known as absolute monarchy lets the ruler have full control of everything and has no limits on his wishes or power. Many immigrants or citizen just wanted to live the American dream, which is considered the opportunity for prosperity and success, and an upward social  mobility that one will achieve through hard work. David Simon believed that money, land or to have opportunity to live a happy life is not based on money. Simon considers that with a minimum wage salary, a small home and a fair government you will be able to pursue and eventually acquired complete or full happiness. He says that the government has only helped the working class by raising wages and going into war so they can win more land and build more factories. In his essay, Simon says â€Å"It took a working class that had no discretionary income at the beginning of the century, which was working on subsistence wages. It turned it into a consumer class† (Simon, 2). The government has converted our people into working animals that only care about making or earning more money to waste it on unnecessary stuff they like but do not need. The engine that drove them to this gullible mentality was the ability to make money and realizing that they are able to afford everything they want and desire even when this desires are not needed. Having a fair society is being able to have moral choices without jeopardizing happiness. â€Å"Are we all in this together or are we all not?† (Simon, 5), David Simon is asking that as Americans we have to work together as a team to ensure everyone has their basic rights and happiness. He believed that capitalism is a good way of making money but it does not solve moral problems. â€Å"The other thing that was there in 1932, that isn’t there now is that some element of the popular will could be expressed through the electoral process in my country† (Simon, 5), he goes to say this because in 1932 the government bought the elections and the people of America were not able to choose their government. I believe that the right to pursuit happiness involves you speaking up when you feel your unalienable rights are being violated. The key word is pursuit, we all have the right to go after the things we want and what we think will make us happy; but happiness is not guarantee, is just the ability to look for it. Furthermore, happiness is not an entitlement either. We all have the right to take action for our own happiness as long as one’s rights are not being infringed. Unalienable rights are given to all human beings by their creator. It is the government’s responsibility to protect them without violating them. Finally, live life in a manner that you believe will lead you to happiness.

The Walt Disney Concert Hall

The Walt Disney Concert Hall in Los Angeles, designed by architect Frank Gehry and completed in 2003, suits its function as both a concert hall and a monument to the Bunker Hill area’s status as a civic center. Its innovative, futuristic form is well-suited to the city’s postmodern landscape, while the interior retains many of the features of traditional concert halls. The building’s form suits its purpose as a music venue.Crafted to include abundant natural light as well as to preserve traditional halls’ acoustic qualities, it features a steel-clad exterior with an undulating, abstract shape, using its own artistic qualities to underscore the facility’s artistic purpose. The interior is vast, dominated by a large pipe organ, but the use of wood, the seating arrangement (which surrounds the orchestra platform instead of simply facing it), and the skylights render the hall comfortable rather than dark and formal.As a cultural facility, the building s uits both the physical and cultural contexts of Los Angeles. The location, the once run-down neighborhood of Bunker Hill, has been revitalized in recent years as a business, shopping, and cultural area, and the structure’s presence attests to the city’s efforts to redefine the place. The concert hall evokes a sense of fascination with the shining, undulating exterior, which gives the building the appearance of a large work of art instead of a traditional venue.The large interior conveys grandeur but is not overwhelming; the wood paneling and abundant sunlight make it seem pleasant rather than stifling. John Donne as an Innovative Poet

John Donne's position as a revered and respected poet is not unjustified. The depth and breath of literary works written about him along with the esteemed position he held among his comtemporaries is evidence of his popularity. As a metaohysical poet his poetry was frequently abstract and theoritical and he utilised poetry to display his learning and above all his wit. He was most certainly an innovative love poet who moved away from the Shakespearian focus on form intensely literary style. He was an expert in argument and often used exr=tended conceits to put forward these arguments.The drama in his poetry and his use of language all serve to highlight his skills as an innovative and creative poet. In order to examine Donne's innovative style I will discuss five of his poems, A Nocturnal Upon St. Lucy's Day, The Flea, A Valediction: Forbidding Mourning, The Sunne Rising and The Anniversarie. Donne was frequently classed as the first and greatest of the metaphysical poets. This group of writers were classed together, not because of any historical connection, but largely due to their similiarity of style. The term metaphysical could be classed in a number of ways the work of these poets was both celebrated and criticised.For many metaphysics was a branch of philosophical speculation concerned with questions of our being and existence. It was often characterised by the se of inventive conceits and speculation on topics such as love or religion. For Samuel Johnson, who coined the term the metaphysical poets, they were overly comcerned with style and the demonstration of learning. He believed these poets, who included George Herbert and Andrew Marvel as well as Donne, were simply using this style of poetry to show off their intelligence, ‘The metaphysical poets were men of learning and to show their learning was their whole endeavour'. Johnson, 1876: 48]. The impact Donne and his innovative style made on his contemporaries is evidenced further when we look at the reaction of his contemporaries to his death. Such was their grief at his passing that a book of elegies dedicated to his was published two years after his death. Among these was Thomas Carew's An Elegie Upon the Death of the Deane of Paul's Dr John Donne. In this Carew laments the passing of Donne and believes that his death will hinder other poets as he was their inspiration. For Carew, Donne's inovation ay in his use of the English llanguage and he described him as having freed the English language from the ‘weeds' which had grown all over it. Carew also suggests that other poets are indebted to Donne as he created a style that was a source of inspoiration for many other poets. This stance in reaction to his death further reinforces the idea that Donne was an innovative love poet and not one who writes with an awareness of tradition of earlier love poetry. William Shakespeare was the Elizabethan era's most prolific love poet. He employed a highly literary style in his w riting and a rigid structure in much of his poetry.A comparison between Donne's work and Shakespeare's traditional love poetry effectively highlights Donne's innovation in the field. Shakespeare's poem Venus and Adonis and Donne's poem A Nocturnal Upon St Lucy's Day are love poems that employ similiar arguments to advance their themes. Donne's innovation becomes obvious however in the style and diffuculty of his argument. In Shakespeares's verse his heroine refuses to believe that her lover has died based on the argument that if he was dead then the whole world would be in chaos and she too would be dead, ‘to wail his death who lives and must not die/ Till mutual overthrow of mortal kind! [Shakespeare 1015 – 1020]. Once the point has been made the poem moves on. In Donne's poem on the other hand his argument on the liklihood of proving his death continues for many lines and utilises comparisons to many scientific points. For Donne it is not the logic of the argument tha t counts but the argument itself and he continues to press the argument until he can go no further. This poem is also evidence of Donne's focus on metaphysics. He uses the unfeeling language of philosophy and science to advance his arguments. Intellectual argument and attempts to persuade are a frequent feature of Donne's poetry.Many of them are exercises in the use and abuse of logic. His poem The Flea contains twenty seven lines of witty closely-knit argument on the significance for two lovers of a flea bite. The poem contains three connecteded arguments; the first it that the flea, who has bitten both the speaker and his lover, now contains the blood of each and so they are mingled withing the body of the flea in which they have effectively made their marriage bed. The second is that by killing the flea, she will be committing murder (killing him), suicide (killing herself) and sacrilege (destroying the ‘temple' which was their marriage bed).The final segment of the argumen t takes place after his lover has killed the flea. The speaker reasons that as neither he nor she has suffered from the death of the flea, if she yields to him, she will lose no more honour than when ‘this flea's death took life from her'. [Donne line 27]. Donne pursues his argument in a reasoned logical fashion and in this poem in particular the argument carries an irreverent tone and through its ludicrousness and wit Donne demonstrates both his intellect and ingenuity.Another of Donne's poem which employs a reasoned argument is Valediction: Forbidding Mourning. Unlike the irreverent tones of The Flea however this poem's argument is filled with emotional intensity as Donne assures his wife that the physical distance between them as he undertakes a long journey to Europe with his patron Sir Robert Drury will not alter their relationship. Are you stuck in a rut Choose your adventure! Do you ever feel like life is an incredible adventure and absolutely anything is possible? I had a week like that. I noticed it particularly on Friday when I went for my normal swim and had so much energy I swam an extra quarter mile past my regular routine, then chased the swim with 30 push-ups. The entire time I felt energized and capable of accomplishing anything I set my mind to. Mental attitude is the biggest factor in producing results. I was reminded of this truth last Thursday night, when, at the Wild Scenic Film Festival, I watched a video about three climbers who scaled Yosemite’s iconic El Capitan. What made this climb particularly impressive is that all of the climbers were disabled. One had been born with just one arm (a â€Å"minor inconvenience† according to him); the two others had lost a leg each, one due to a climbing fall and the third from bone cancer. Said one of the men: â€Å"The right attitude and one arm will beat the wrong attitude and two arms, every time.† If you have any doubts, watch this inspiring film: Mind you, I am not planning on scaling any peaks even with all my limbs- not in this lifetime. But the sense of excitement that spurs these climbers is accessible to all of us at every moment. For me, it started with an assignment I was given during a workshop with the Wright Institute in Chicago. Prior to the workshop, I was in a rut. Daily tasks were feeling like a grind and I thought that maybe I needed to travel out of the country for a while to break my routine. Then came the homework for the first night of the workshop: to create an adventure! The adventure begins†¦ It was already midnight and class was starting up again at 8am the next morning. What adventure exactly was possible in that short a time frame? I found out the next morning. I woke up before my alarm sounded with cramps, in an empty house that belongs to my cousin Zack. I thought to myself, â€Å"I could lie here trying to sleep or I could get up and have an adventure!† I decided to get out of bed. As soon as I entered the shower I remembered that Zack had mentioned a big bathtub with whirlpool jets somewhere in his house. I don’t normally take baths, but this time I decided to interrupt my regular pattern. I got out of the shower and began searching for the whirlpool, towel wrapped around me, leaving a trail of wet footprints. In the basement, I found a bathtub †¦ full of cleaning supplies. The search continued, and I finally found the whirlpool, which I filled up †¦ but I couldnt figure out how to turn on these fabled jets. I got into the tub anyway, but thought, â€Å"Hey Im on an adventure! This won’t do!† So I got out of the tub, looked at all the switches on the walls, and finally figured it out. Back in the tub, I noticed a line of tea light candles along the side of the bath. But no matches. My refrain: â€Å"Im on an adventure!† So I got out of the tub, looking everywhere until I found matches. I was going to do this thing the right way! After a few minutes the jets turned off and suddenly I was relaxed and floating in a self-made paradise, being held gently by warm water, surrounded by glowing candlelight. I was so glad I had chosen this adventure, rather than sleeping another hour or going to my default of â€Å"I don’t take baths.† Unexpected treasures, unprecedented energy†¦ When I went to hang up my towel, for some reason I decided to look behind the door rather than hang the towel where I had put it before. I found two beautiful dragonfly hooks which I hadn’t noticed before. Who knows what can show up out of a sense of adventure? Who knows what else I had been missing? My adventures continued in the days following the workshop. Out of a conversation with a friend that felt a bit scary at first, I unexpectedly drove to Minneapolis and stayed two days, all because I decided to take some risks and not let anything stop me. Today, a week after the conclusion of that workshop, my energy is still high and I can’t wait to discover what’s next. So how about you? Besides, a very important document was adopted in 2001 – a new statutory guidance from New Labour Government Inclusive Schooling: Children with Special Educational Needs (DfES 2001) which sets out the main principles of inclusive education: with the right training, strategies and support nearly all children with special educational needs can be successfully included in mainstream education; an inclusive education service offers excellence and choice and incorporates the views of parents and children; the interests of children must be safeguarded; schools, local education authorities and others should actively seek to remove barriers to learning and participation; all children should have access to an appropriate education that affords them the opportunity to achieve their personal potential; mainstream education will not always be right for every child all of the time. Equally, just because mainstream education may not be right at a particular stage it does not prevent the child from being included successfully at a later stage. This document stipulates that schools and local education authorities ability to refuse a mainstream place for a child with special educational needs is severely restricted. They are able to refuse a mainstream school place to a child if it would be incompatible with the efficient education of others; however, reasonable steps must be taken to prevent that incompatibility (DfES 2001). The Green Paper Every Child Matters further illustrates New Labours commitment to reform services delivered to children, especially those with SEN, with the purpose to provide all of them with the opportunity to be healthy, to stay safe, to have high academic attainments, to participate in life of community, enjoy and develop, and to achieve financial well-being. The focus of this document is on early intervention, removing the barriers to learning – both physical and social, preventative work and integrated services for children (DFES 2003). The latter provision reasonably stresses importance of transagency collaboration and coordination to achieve better quality of services delivered to children in need. The use of collaborative teaming among professionals, agencies, the child, and family members, the use of the curriculum that focuses on the interactions between the pupil and his/her environments as well as the establishment and use of interagency linkages to facilitate the smooth integration of the child in mainstream school are the most important components of this cooperation (Cheminais 2006, p.19). A crucial motif in such policies is the idea of equal worth and recognition for people deemed to be disadvantaged, marginalised and excluded. Notions of children locked in cycles of personal and social deprivation, excluded, but also self-excluding, emotionally damaged and lacking confidence and skills permeate these initiatives (Rieser 2000, p. 148). The introduction of the National Childcare Strategy and Quality Protects with its strong recommendation that local authorities appoint a Childrens Rights Officer for looked after children, combined with the establishment of the Social Exclusion Unit and a number of community initiatives such as Sure Start designed to help preschool children, have increased assistance to children and their families, especially in severely disadvantaged areas (Pugh 2005). But any review of the Labour governments record must include brickbats alongside bouquets. New Labour has reduced the number of children in poverty in recent years but the figures remain substantial for a country which ranks among the seven most industrialised nations in the world (Corbett 2001, p. 67). Young people under the age of 22, moreover, are exempted from the adult minimum wage of ? 4. 10 (Rieser 2000, p. 154). The centralisation of education, the imposition of national curricula and league tables and the privatising of certain aspects of education, are unlikely to promote childrens participation rights or provide them with a voice in the running of their inclusive schools. Perhaps most significantly, New Labours election has regressed into a populist and authoritarian series of measures, such as curfews and electronic tagging. The Home Office, moreover, encouraged public perceptions of young people as unruly, out of control and requiring policies which stress containment (Robertson 2003). Indeed, children must be subject to the necessary guidance and discipline of adults, but they have to be partners in this process – not just passive recipients, if we talk about real inclusive schooling. In actual fact, legally, the paternalistic notion that the best interests of the child must be protected has increasingly come to be supplemented by the principle that children have a right to express their views and have their wishes taken into account in legal decisions which concern them (Cheminais 2006, p. 23). In particular, the Children Act 2004 carefully straddles the divide between protectionist or paternalist and participatory rights. Its guiding principle is that the childs welfare is paramount, but the legislation also supports the principle that, where possible and appropriate, the ascertainable wishes and feelings of the child concerned should inform decisions (HMSO 2004, Part 2). In truth the judiciary continue to interpret this latter requirement conservatively falling back on paternalistic assumptions of childrens incompetence (Robertson 2003). Thus, it comes as no surprise that Armstrong (2005, p.138) argues that a transformatory agenda [of New Labour government] may be characterized by the rhetoric of change rather than by any substantive transformation of values and practices. Moreover, contradicting to its own declared values concerning inclusive education New Labour government sees special schools at the front position of the wider education agenda and emphasises the need to recognise and value their contribution within a framework of inclusion (DfES 2003). It is obvious that continuation of segregated special schools is contravening human rights – real inclusion cannot happen in the special school. As recent studies on the trends in the UK educational system show that he formalisation of relationships in education has been encouraged by the growing tendency towards extending the scope of bureaucratic intervention in the everyday life of schools (Atkinson et al. 2002). Increasingly, every aspect of education is subjected to rule-making and regulated through inspection and auditing. As a result of a highly centralised system of education managed by an interventionist bureaucracy little is left to chance (Foley et al. 2003, p. 112). It has been noted that even primary school teachers are allowed little initiative to exercise their professional judgment. The national curriculum dominates the classroom and teachers activity is regulated by the need to respond to the demands of standardised tests and inspections (Thomas Vaughan 2004, p. 63). The expansion of bureaucratic control is justified on the grounds that it ensures the maintenance of standards of education (Armstrong 2005, p.141). While the impact of the standardisation of teaching on the quality of education is debatable, its consequences on the relationship between the different parties – teachers, students, local authorities, parents – are strikingly clear. New Labour government declared that its top priority is raising educational standards – it is a great target, but what is troubling that the governments purpose has also been clearly signalled – education is valued less for its intrinsic qualities of self-development and more for its contribution to creating a new kind of society (Armstrong 2005, p.136). In that way, future prosperity of the UK rests with its capacity to develop and harness the skills required to be a significant player in the new knowledge-based international economy. Here it is evident that New Labour government sees the role of education explicitly in terms of social engineering. It means that the inclusion agenda in the UK has a moral and rhetorical appeal, while its conceptual vagueness can be seen after closer analysis. Conclusion. The conducted study demonstrated that there are no simple solutions to the task of inclusive thinking, relations and practice, that here is no room for complacency in the pursuit of understanding and implementing inclusive education. Without a doubt, inclusion can make great contribution to maximising the participation of all learners and the removal of discriminatory and exclusionary assumptions and practices in schools. Fortunately, recently society has shifted from a sentimental approach to disability to one which concerns entitlement. Inclusive education theorists and practitioners have moved distinctly on from a preoccupation with mere physical location in a school or college and a campaigning for civil rights issues. Physical access and disability rights continue to be ongoing struggles and theoretical concerns but the overriding practical priority in schools is that of coping with difficult behaviour and with learning difficulties. Here it is important not to see inclusion as the concern of special educators but of concern to all those involved in the school or college settings. While the earlier integration focus tended to be on physical access and specialist resources, inclusive education implies a shared responsibility and a joint concern. In such a way, now SEN is at the core of educational agenda, and it is seen as the business of mainstream schools to address basic skills and to meet individual needs. If successfully implemented inclusive schooling can give the opportunity for children with a disability to participate fully in all the educational, employment, consumer, leisure, community and domestic activities that characterize everyday society. But to advance an agenda for inclusion and to make the ideals represented in New Labour government policies a meaningful reality in schools, the society has much to do. Our study proves rightfulness of Armstrong’ arguments that even if being ambitious and extensive New Labour’s policies promulgating inclusive education do not yielded in practical results for children with SEN. To date they remain in many aspects just a declaration of what changes in education would be implemented, but the rhetoric of change has not been followed by substantive transformation of values and practices towards inclusion. Many children come to school with problems. Recognition of this and sensitivity to it is part of inclusive education as we revealed in our study. A responsive school climate, which views problems as challenges and not obstacles, is a key factor in successful movement to really inclusive education. The focus in it has to be on institutional systems, attitudes, flexibility and responsiveness rather than on the special needs child. In order to provide such a highly developed level of inclusiveness, schools have to be willing to work consistently on improving and adapting both their curriculum and social climate. It has to be a school which relates to individual needs, institutional resources and to community values. Today inclusion in school settings, for all the political rhetoric, remains the cause of a good deal of anxiety with the vast majority of teachers, parents and children. To work to advance an agenda for inclusion, in the target-driven and achievement-oriented market place that education has become, requires placing emphasis on breaking down the barriers which create exclusion. It means that we have to work on the attainment of a more inclusive society, which is not solely the responsibility of teachers in schools, and which is most likely to be achieved only when we will be able to develop a more equitable educational system. Transient Global Amnesia A little while ago, my father and grandfather were driving in our car together. All of a sudden, my grandfather said that he was feeling dizzy and thought the beginnings of a migraine were coming on. My grandfather is extremely healthy and has an amazing memory, so my father was shocked when not long after, when grandfather asked where Ruthy, his recently deceased wife, was. When my father reminded him that she had died of cancer last year, my grandfather broke into tears, as if he was being told for the first time. In addition, he couldn't even remember what he had just eaten for dinner or any other events of the day. My father drove him straight to the emergency room, worried that he had perhaps just suffered a minor stoke. By the time that he got to the hospital, he was already beginning to regain some of the memories that had been lost. The doctors reassured him that it was not a stroke, but rather a memory disorder called transient global amnesia. Transient global amnesia (TGA) is a type of amnesia involving the sudden, temporary disturbance in an otherwise healthy person's memory. The other main kinds of amnesia are called anterograde and retrograde amnesia. Anterograde amnesia is a type of memory loss associated with a trauma, disease, or emotional events. It is characterized by the inability to remember new information. (1) Retrograde amnesia is associated with the loss of distant memories usually preceding a given trauma. (2) In transient global amnesia, generally both distant memories and immediate recall are retained, as are language function, attention, visual-spatial and social skills. However, during the period of amnesia, people suffering from the disorder cannot remember recent occurrences nor can they retain any new visual or verbal information for more than a couple minutes. (3) Though patients generally remember their own identities, they are often very confused by their surroundings and the people around them. T hey continuously ask questions about events that are transpiring, for example where they are, who is with them, what is happening. However, once they are told, they immediate forget the answer, and repeat the question again. (4) The period of amnesia can last anywhere from one to twenty-four hours. Some people suffer from a headache, dizziness, and nausea while others have only memory loss. TGA generally affects fifty to eighty-year-old men, about 3.4 to 5.

Only a Surfer Knows the Feeling There is a guy from Hawaii that I know. Every day, he wakes up, straps his surfboards to the racks on top of his car, drives his car from a town called Ewa, across the island of Oahu, to a little beach known as Ala Moana Beach Park. He does all of this even before the sun comes up. He spends a few minutes just looking at the ocean, watching and surveying the waves and how they break. As soon as the sun makes its first peek over the horizon, he grabs a board, waxes it up, and jumps in the water. He then paddles his board through what many people call a journey: two hundred yards of dark cold water, blistering currents, and waves pushing back against each stroke made to push forward. He makes this journey to get to a point right past where all the waves break, to a point called the line-up. It’s here, where he waits for a wave that he catches back towards the shore, only to make the journey back through all the cold harsh currents and waves again. He catches a few waves, and the n catches one all the way back to shore, where he showers, gets dressed and then goes off to work. He has one of the most stressful jobs I can think of. He is a counselor at one of the local shelters for teenage runaways. He deals with teen depression, suicidal tendencies, and coordinates bringing these kids back together with their families. And even though these tasks aren’t what most people would want to have to put up with in their lives, he does it every day. Furthermore, as stressful as his job seems to be, this man is one of the mellowest guys that I know. When asked why he does this morning ritual every day, he said, â€Å"surfing helps keep me focused†. And I believe him.   Ã‚  Ã‚  Ã‚  Ã‚  Think about it for a moment, each time a surfer goes to a beach, waxes up his board, and surveys the waves from the shore, he is preparing to go into the water to do something quite amazing. This person is willing to test not only his limits, but also the limits of what the ocean can do to him. He wants to battle the power of the entity that covers over seventy percent of the earth, manifested in the form of a wave, and ride it for all its worth.

Critical Analysis of Emily Dickinsons My Triumph Lasted Till the Drums

English 1102 2/20/13 A Characterization of the Narrator in My Triumph Lasted Till the Drums The speaker in Emily Dickenson’s â€Å"My Triumph Lasted Till the Drums† is very torn between rejoicing in the victory in the battlefield, and the regret they feel for the battles losers. The narrator feels pride at first, as shown in line 1 and the title’s use of the word â€Å"Triumph† yet that pride quickly turns into regret and disdain.The narrator laments what they feel are senseless acts of war and their deep regret turns into wishing the roles were reversed and they had died. In â€Å"My Triumph Lasted Till the Drums† the narrator describes the triumphant feeling at the end of a victorious battle. â€Å"My Triumph† means that the speaker recognizes that there was a victory and that they are on the side of the victors whom should feel jubilant in victory. The use of the word Triumph shows that the speaker is aware that there is a great sense of p ride to be had in winning a battle.This feeling, however, is very short lived. The speakers â€Å"Triumph† lasted only â€Å"till the drums/and then I dropped my victory†¦Ã¢â‚¬  as noted in lines 3 and 4. These lines show the speakers a compassionate and caring person who feels remorse immediately after the triumphant feeling subsides. The speaker in â€Å"My Triumph† is an average person who is thrust into battle, emerges victorious, and sees that there is more defeat in victory than they realized.The narrator sees the reality of a cruel battle and the loss of lives and realizes that though they are victorious, the defeated are all dead. This deeply troubles our speaker as evidenced in line 15 and 16 where the speaker says â€Å"A Bayonet’s contrition/Is nothing to the Dead. † In this line the speaker is saying that the regret held by the bayonet and the hands guiding it means nothing to the dead man at the other end of the blade. This regret show s a person who may have enlisted, but now know that the brutality of war is not for them. And then I hated Glory/And wished myself were They,† lines 7 and 8, show just the conviction with which our speaker hates war. They wish themselves dead and that the defeated had been the victors. The narrator in the poem is a remorseful soldier looking upon the dead bodies of their enemies in combat. There is a great feeling of pride, but it is followed by the feeling of sorrow for the dead combatants. The speaker’s feelings are that the â€Å"Tyrannies of Men† are unnecessary truths of war.

Professional Issues in Nursing Essay

As a nurse, I make judgement that would affect patient’s health every day, I am aware that I have a great duty to ensure my patient’s safety to maintain the public trust (Chitty & Black, 2011). After learning this module, it helped me acquire adequate knowledge to better manage legal and ethical issues at work. For the sake of providing a high quality of care to my patients, I must be knowledgeable in both (Croke, 2003). Nowadays, the public is aware of legal issues and organized information is available through the internet. As a result, medical litigation claims have been rapidly increasing. Most claims against nurses are due to medical negligence (Tay, 2001). I am liable for my own practice, and if I fail to act as a reasonable prudent person in certain conditions, I may be liable for medical negligence (Chitty & Black, 2011). Research shows several errors leading to nursing negligence. For instance, a nurse fails to follow standards of care, fails to use equipment in a responsible manner, fails to communicate, fails to document, fails to assess and monitor and fails to act as a patient’s advocate (Croke, 2003). In 1998, Hurwitz states in order to prove medical negligence, the patient plaintiff must prove: The defendant nurse owned the plaintiff a duty of care and breached in this duty of care by failing to provide the required reasonable standard of care. Thus this breach of duty of care caused the plaintiff damage. I would like to discuss a case encounter in my practice for example to reflect my knowledge. A 55 year old patient admitted for chest pain and on telemetry monitoring. This patient requested for shower, a nurse removed his telemetry and was ask to assist the patient during shower, but the patient insisted to shower on his own. Then the nurse left the patient alone without instructing him to call for help if he felt any discomfort. After a while, the nurse went back to check, patient was found collapsed on the toilet floor. The issue that came across my mind is â€Å"If I am that nurse, am I negligent?† Learning point 1: Duty of care A patient went to the hospital and hospital is agreeable for patient’s treatment, there will be a contract between the hospital and patient. The hospital has the duty to provide quality treatment to the patient. Nurse as the employee, if he acts badly, it can be reasonably foreseen that the  patient may be injured. Therefore the nurse owes a duty of care in treating the patient (Staunton & Whyburn, 1996). In this scenario, I have a bond with my patient; therefore I owe a duty to provide reasonable and competent care to my patient (Hurwitz, 1998). Learning point 2: Standard of care The nursing standard of care is what the reasonably prudent nurse did in the same circumstances (Staunton & Whyburn, 1996). In Singapore, we have the standard of care and code of ethics for nurses and midwifes as our guideline for practice, it is our responsibility to follow the standard ( Singapore nursing board, 2011). In this case, the patient’s determination to shower without assistance, is his autonomy (Tay, 2001). According to value statement of code of ethics, I respected the patient’s individual needs and privacy, and also respected and promoted patient’s autonomy by allowing patient to do so (Singapore Nursing Board, 2011). In this case, there is a conflict between respecting patient’s autonomy and providing care in a responsible and accountable manner. I need to make a choice between two alternatives. There is no absolutely right or wrong decision (Keilman & Dontje, 2002). The decision made by me is to respect the patient’s autonomy, but this may violate the principle of non-maleficence as this decision of allowing patient to shower alone may delay the time to find out patient has collapsed, then it unintentionally caused harm, so I failed to provide in a responsible and accountable care (Chitty & Black, 2011). If I choose to provide care in a responsible and accountable manner, I should have insisted to accompany patient, but by doing so I may violate patient’s autonomy. According to standard of care of nurses and midwives, I should communicate with client effectively and provide appropriate information to the patient (Singapore nursing board, 2011). I should inform patient that he is on high risk of developing heart attack and shall be monitored closely. Failure to communicate effectively leads a breach of duty. Learning point 3: Avoid medical negligence To avoid medical negligence, I think the most important is to prevent the breach of duty of care. According to Bolam test, I will not breach the duty of care if I followed the standard of care (Hurwitz, 1998). In order to meet the standard of care, I need to be a knowledgeable and a safe practitioner,  be technically competent, and keep up-to-date with current practice (Chitty & Black, 2011). We must be familiarized with the standard in nursing practice. When we use them to guide our daily practice, we are acting in the best interest of the patient (Singapore Nursing Board, 2011). When you do decision making, ask yourself, â€Å"have you followed the standard of care?† Nowadays, â€Å"the nurses are also being encouraged to act as advocates for their patients, to safeguard standards of care and to speak out where those standards may be at risk.† (McHale & Tingle, 2001, p36). I think, our role as an advocate needs to improve, as nurses do not have the courage to interr ogate the doctor’s order. Clinical improvement If this scenario happens again, what do you think will help the patient? I feel there are some good strategies to adhere: Set hospital policy and educate the staff to provide comprehensive information (Chitty & Black, 2011), for example, they must understand that for clients on telemetry monitoring, patient should not be left alone. The patient must be warned that he is at risk of heart attack. To persuade patient for his desired action, and for his own safety, he should allow assistance. If patient is stubborn and insists to shower without supervision, delegate a staff to standby at the shower door, the hospital need to ensure adequate staff patient ratio (Chitty & Black, 2011). Kohlberg`s Three Levels and Six Stages of Moral Reasoning

Lawrence Kohlberg, a professor of psychology in the University of Chicago, has created his own theory of moral development. The theory is based on children’s reasoning, when facing moral dilemmas, however, Kohlberg went far beyond that and created a common theory for all ages. Under his theory moral thinking passes through six separate stages, which are broken into three levels. This paper aims to provide a review of stages and levels proposed by Kohlberg.  The first level is PRE-CONVENTIONAL. This level is more characteristic for children, although it is sometimes passed by adults too. At this level an individual considers exclusively direct consequences of an action for himself. Reasoning at this level is purely egoistic and consists of two stages:Stage 1 An individual concentrates only on direct consequences for himself and the main moral deterrence is fear of punishment. Moral futility of an action is estimated by punishment. The more severe is the punishment, the worse an action is[1].Stage 2 is characterized by limited interest to the needs of others. However, this interest is of egocentric. A person is interested in getting something for himself for his/her moral behavior[2].  The second level is CONVENTIONAL. This stage is typical for most adults. At this level individuals compare the morality of their actions to social norms and expectations. This level includes the third and fourth stage of moral reasoning.Stage 3 is related to social roles. People act so, as their relatives, friends and members of their group act to receive their praise. Actions are evaluated in terms of personal relationships and social stereotypes. The main deterrence is fear of authority and fear of social condemnation[3].Stage 4 is similar to stage 3, however it is extended as actions are evaluated in terms of laws and social conventions. Individual needs are overcome at this stage and laws are attributed own value. A distinction between right and wrong in this stage i s created by culpability of an action.  The third level is POST-CONVENTIONAL is also called â€Å"principled level†. Actions are evaluated by an individual before they are evaluated by society. A person becomes morally â€Å"autonomous†[4]. The level includes stages 5 and 6.Stage 5 At this stage an individual comes to understanding, that people hold different views and opinions. Laws are understood not only as rules, but as useful social contracts. Those, who act against common good are considered to be morally bad and those have to be changed. The aim of morals is understood as â€Å"as much good for as many people as possible†, which is achieved by decision of the majority.Stage 6 is characterized by abstract reasoning and universality of ethical principles. An individual comes to understanding that any laws may be justified only to the extent they correspond those universal principles[5]. The social consensus is reached after â€Å"seeing the situation fro m another man’s eyes†. It is firstly necessary to get full understanding of all moral positions on the matter and after that a consensus between those positions should be reached. This lack of emotion is vivid in his reaction to his mother death. Even the telegram bearing the message of his mother death is not worthy of much attention. This disinterestedness to his mother’s is revealed in his indifferent description, as he says, â€Å"Maman died today. Or yesterday maybe, I don’t know. I got a telegram from the home: â€Å"Mother deceased. Funeral tomorrow, Faithfully yours† That doesn’t mean anything. Maybe it was yesterday.† (Chapter 1, Part 1) Indeed this lack of hope evolves also from Meursault’s incapability to reason. Meursault kills Raymond’s mistress’s brother without thinking of what death means to others. He cannot think of others in his world because he is extremely self-oriented. According to Department of Health (2011), the Act stipulates that the hospital should give Brad information about his rights as a compulsory patient. This is essential in facilitating the effectiveness of the assessment and treatment process. Furthermore, the Act allows hospital to use his medical records for the purposes of their annual record validation. However, the details of the record should not be made public against his wish. Brad can look at his own medical records through the help of the nearest relative. The Act has a provision that gives the nearest relative the right to receive written information concerning the detention of the patient. Family Law Task A2.
